Volkswagen/Audi Diesel Emission Fraud Cases
Helping Clients File Consumer Fraud Claims
The US Environmental Protection Agency (EPA) uncovered that VW and Audio sold cars with faked emission standards, by developing a device that intestinally cheated pollution testing. The VW emissions system is outfitted with a “defeat device” that reduces the amount of mono-nitrogen oxides emitted. The device software switches to a cleaner mode during emissions testing. During normal operation of the vehicle, the car is emitting 10 to 40 times the legal pollution limit.
The action taken by VW is unacceptable, as this automaker has been the leader in the US for “clean diesel vehicles”. Their customer base was misled into purchasing a vehicle that was environmentally friendly.
The EPA has announced that Volkswagen has been given notice to recall all the vehicles sold under false pretenses.
Affected VW models:
- Volkswagen Golf (2009-2015)
- Volkswagen Jetta (2009-2015)
- Volkswagen New Beetle (2009-2015)
- Volkswagen Passat (2014-2015)
- Audi A3 (2009-2015)

How Does This Impact the Loyal VW/Audi Owner of Virginia & North Carolina?
Although the EPA announced that it would-would require Volkswagen to recall the affected vehicles, no official recall has been announced as of yet, as Volkswagen has yet to outline a strategy for fixing this problem. In the meantime, the EPA has said that owners of affected vehicles should continue to drive their vehicles as normal, as these cars pose no safety risks to drivers or others on the road.
There are several issues which can arise:
- Resale value of automobile
- The driver faces a recall to reprogram engine, which could lower horsepower and fuel efficiency
- Owner confidence in vehicle
If you own a Volkswagen or Audi included in this recall, you have been a victim of consumer fraud.
Kalfus & Nachman PC can help you with your legal options available for you to take action against Volkswagen for their false advertising and the violation of your consumer rights. Virginia claimants may be entitled to three times their actual losses if it is determined that VW’s violations were willful. (§59.1-204).
