Drunk Driving Laws in Virginia
Virginia law prohibits driving under the influence (DUI) and driving while intoxicated (DWI). In most cases, if your blood alcohol concentration (BAC) is 0.08% or higher and you are pulled over by law enforcement, you will be charged with DUI. However, even if your BAC is below 0.08%, you can still be charged with DUI if you are driving while your ability is impaired by alcohol, drugs, or a combination of the two.
For commercial drivers, the BAC limit is 0.04%, and for drivers under the age of 21, the BAC limit is just 0.02%. In other words, if a driver under the age of 21 has consumed any amount of alcohol, they can be charged with DUI.
Virginia has a zero-tolerance policy for underage drinking and driving, so if a driver under the age of 21 is found to have consumed even a small amount of alcohol, they can be charged with DUI and face the same penalties as those who are 21 or older and driving with a BAC of 0.08% or higher.
In addition to criminal penalties, such as jail time, probation, license suspension, and fines, a person convicted of drunk driving in Virginia will also face a civil lawsuit if they cause an accident that results in injuries or death.
